1. Scope and contracting parties
1.1 These General Terms and Conditions apply to all orders placed through our online shop.

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
1.3 An entrepreneur is a natural or legal person or a legally capable partnership that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.
2. Conclusion of the contract
2.1 The presentation of the products in our online shop does not constitute a legally binding offer, but rather an invitation to place an order.
2.2 The customer can place the desired products in the shopping cart and check and correct his entries before completing the order.
2.3 By clicking the button „"Agreement to pay for the order you are placing"“ or by clicking a clearly labeled order button, the customer submits a binding offer to conclude a purchase agreement for the goods contained in the shopping cart.
2.4 After receiving the order, the customer will receive an automatic order confirmation by email. The purchase agreement is concluded when we accept the order by sending an order or shipping confirmation or when we ship the ordered goods.
2.5 For payment methods with immediate payment authorization or debit, payment can be made immediately after placing the order. If the order is not accepted, any payments already received will be refunded.
2.6 The contract language is German.
2.7 The order data will be stored in accordance with statutory retention requirements. The customer will receive the essential order data by email.
3. Prices and shipping costs
3.1 All prices stated in the online shop are final prices in euros and include the applicable statutory value added tax.
3.2 Shipping costs may apply in addition to the price of the goods. The amount of the shipping costs will be displayed to the customer before the order is completed.
3.3 The applicable shipping costs and any free shipping threshold offered are indicated in the online shop and during the ordering process.
3.4 No shipping costs will be charged if the order is collected by prior arrangement.
4. Payment terms
4.1 The available payment methods are displayed to the customer during the ordering process.
4.2 Electronic payment processing is handled via the payment service provider. Stripe.
4.3 Depending on the payment methods activated in the shop and available to the respective customer, credit and debit card payments, as well as other payment methods offered via Stripe, can be used. The payment methods displayed in the respective order process are decisive.
4.4 Where offered during the ordering process, Apple Pay or Google Pay can also be used.
4.5 The payment method will be debited according to the terms and conditions of the selected payment method.
4.6 There is no entitlement to the availability of a specific payment method.
5. Delivery, shipping and collection
5.1 Delivery will be made to the delivery address specified by the customer during the ordering process.
5.2 Unless a different delivery time is specified for the respective product, the delivery time within Germany is... 3–7 working days after conclusion of the contract or, in the case of payment methods requiring advance payment, after successful receipt of payment.
5.3 The stated delivery time includes processing and shipping time. As we are a small company and sometimes hand over orders to the shipping provider in batches, handover to the shipping provider does not necessarily occur on every working day.
5.4 In the unlikely event of a significant delivery delay, we will inform the customer as soon as possible.
5.5 Delivery will be carried out by a shipping service provider selected by us.
5.6 As an alternative to shipping, a Collection by prior arrangement Possible. The collection date will be arranged individually with the customer. There are no shipping costs for collection.
5.7 For orders containing multiple items, partial deliveries are permitted, provided this is reasonable for the customer. The customer will not incur any additional shipping costs as a result.
5.8 If delivery is not possible due to an incorrectly specified delivery address or for any other reason attributable to the customer and the goods are returned to us, the customer may be charged the actual reasonable costs incurred for a reshipment.
5.9 In the case of consumers, the risk of accidental loss or accidental damage to the goods generally only passes to the consumer upon delivery of the goods to the consumer or a recipient designated by him.
6. Youth protection and the sale of alcoholic beverages
6.1 Our range of alcoholic beverages is aimed exclusively at Adults aged 18 and over.
6.2 By placing his order and agreeing to these General Terms and Conditions, the customer expressly confirms that he has reached the age of 18 and is of legal age.
6.3 Orders from minors will not be accepted.
6.4 The customer must ensure that the ordered alcoholic beverages are received exclusively by himself or another adult.
6.5 We reserve the right to verify the age of the customer or recipient in an appropriate manner and, if necessary, to request the presentation of a valid official photo ID.
6.6 If legal age cannot be confirmed during a required age verification, the delivery of the goods may be refused.
6.7 Even when picking up orders on site, alcoholic beverages will only be sold to persons of legal drinking age. In case of doubt, a valid official photo ID must be presented.
7. Retention of title
7.1 The delivered goods remain our property until the purchase price has been paid in full.
7.2 With respect to entrepreneurs, we retain title to the goods until all claims arising from the ongoing business relationship have been settled in full.
8. Right of withdrawal
8.1 Consumers generally have a statutory right of withdrawal for distance contracts. The statutory withdrawal period is generally 14 days.

9. Transport damage
9.1 If goods are delivered with obvious transport damage, we ask the customer to report the damage to the delivery person immediately if possible and to inform us.
9.2 Failure to make such a complaint or notification will not affect consumers' statutory warranty rights.
10. Liability for Defects and Warranty
10.1 The statutory provisions regarding liability for defects apply.
10.2 Wine is a natural product. Vintage-related and natural variations in color, taste, aroma, or other characteristics do not constitute a defect, provided the goods possess the agreed-upon or customarily expected quality.
10.3 The customer's statutory rights due to defective goods remain unaffected.
11. Liability
11.1 We are fully liable for damages resulting from intentional or grossly negligent conduct on the part of ourselves, our legal representatives or agents.
11.2 In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for this type of contract.
11.3 Essential contractual obligations are those obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely.
11.4 The foregoing limitations of liability shall not apply to damages resulting from injury to life, body or health, nor in cases of mandatory statutory liability.
12. Consumer Dispute Resolution
We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
13. Applicable Law
13.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
13.2 In relation to consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded to them by mandatory provisions of the state of their habitual residence.
14. Place of jurisdiction for entrepreneurs
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship is – to the extent legally permissible – our place of business.
